Article 1 – Identification of the Seller
These General Terms and Conditions of Sale (GTCS) apply to all sales made by:

These GTCS are intended for professional clients.
Article 2 – Purpose
These GTCS govern the sales of agricultural equipment, direct seeding equipment, handling equipment, spare parts, accessories and equipment marketed by PLC Tech.
Any order implies full and unconditional acceptance of these GTCS.
Article 3 – Products
The essential characteristics of the products are presented on the website or in the commercial documents of PLC Tech.
Photographs, diagrams and illustrations are provided for informational purposes only and do not have any contractual value.
PLC Tech reserves the right to modify its products at any time in order to improve their performance or reliability.
Article 4 – Prices
Prices are expressed in euros.
Unless otherwise stated, the displayed prices are excluding tax (ET). The applicable VAT is added in accordance with current regulations.
Transport, packaging or insurance costs are charged additionally when applicable.
PLC Tech reserves the right to change its prices at any time. Products are billed according to the prices in effect on the day of the order.
Article 5 – Orders
The order becomes firm and definitive after acceptance by PLC Tech.
PLC Tech reserves the right to refuse any order presenting a risk of insolvency or following a previous dispute.
Any modification or cancellation of an order requested by the customer must be subject to prior written agreement from PLC Tech.
Custom-made products or specially ordered for the customer cannot be cancelled after order validation.
Article 6 – Payment terms
Payments can be made by credit card, bank transfer or cheque.
6.1 – Orders via the online shop
Orders placed directly on the online shop are payable in full and in advance, at the time of order validation.
No preparation or shipment of orders will be made before full payment is received.
6.2 – Orders outside the online shop (quotes, direct orders)
For orders processed outside the online shop:
- For orders of an amount less than or equal to €1,300 excluding VAT : full payment at the time of order;
- For orders of an amount greater than €1,300 excluding VAT : a deposit of 30 % at the time of order validation, the balance being due before shipment of the products.
6.3 – Products subject to special conditions
Some products, particularly specific, customised or made-to-order equipment, may be subject to particular payment conditions.
In this case, the applicable conditions are specified at the time of order and take precedence over the general rules defined above.
6.4 – Principle of priority
In the event of a contradiction between the different payment methods, the specific conditions indicated on the quote, invoice or at the time of order take precedence over the T&Cs.
Any delay in payment will automatically result in:
- the application of late payment penalties calculated based on the current legal rate increased in accordance with the applicable regulations;
- a fixed compensation of €40 for recovery costs.
Article 7 – Delivery
PLC Tech ensures deliveries in France, within the European Union and internationally.
Delivery times are given as an indication and may vary depending on the nature of the products, their availability, manufacturing constraints and transport conditions.
These times can range from a few days to several months depending on the products concerned.
A delay in delivery cannot give rise to the cancellation of the order, refusal of the goods or a claim for damages, unless prior written agreement from PLC Tech.
The customer is required to check the condition of the goods upon receipt and to immediately raise any necessary reservations with the carrier.
Article 8 – Retention of title
The products remain the exclusive property of PLC Tech until full payment of the price, including interest and accessories.
The transfer of risks occurs as soon as the products are made available or delivered.
Article 9 – Returns
No return of goods will be accepted without prior written agreement from PLC Tech.
Any request for return must be made in writing and specify the reasons given.
Return costs are the responsibility of the customer unless otherwise agreed by PLC Tech.
Custom-made or personalised products are neither returned nor exchanged.
Article 10 – Warranties
The products sold benefit exclusively from the legal warranties applicable between professionals, notably the warranty against hidden defects provided for by articles 1641 and following of the Civil Code.
The warranty does not cover, in particular:
- normal wear and tear;
- damage related to improper use;
- defects resulting from incorrect assembly;
- modifications or repairs made without the agreement of PLC Tech;
- damage caused by insufficient or inappropriate maintenance.
Article 11 – Liability
PLC Tech's liability is strictly limited to the replacement or refund of the product recognised as defective.
PLC Tech cannot be held responsible for indirect damages, loss of earnings, crop losses, production losses or financial harm suffered by the customer.
Article 12 – Force majeure
PLC Tech cannot be held responsible for any delay or failure resulting from an event of force majeure as defined by French law.
Article 13 – Personal data
The personal data collected is used solely within the framework of the business relationship and order processing.
In accordance with applicable regulations, each customer has the right to access, rectify, and delete their data.

Article 14 – Applicable law and competent jurisdiction
These general terms and conditions are subject to French law.
In the event of a dispute, the parties will strive to seek an amicable solution.
Failing an amicable agreement, any dispute will be submitted to the exclusive jurisdiction of the courts of the jurisdiction of the registered office of PLC Tech, even in the case of multiple defendants or a call for guarantee.
